Top Wanaka skier fights assault conviction

An appeal has been lodged by New Zealand's top big mountain free-skier Sam Smoothy to overturn his recent conviction for assault.

The appeal was lodged in the Queenstown District Court yesterday and will be processed and heard in the High Court at Invercargill at a date to be confirmed.

Smoothy (22) was convicted in the Queenstown District Court last week for punching John O'Sullivan in a late-night altercation at a bar in Wanaka in October.

Mr O'Sullivan had offered to trade a mobile phone for one of Smoothy's female friends. He suffered lacerations to his face as a result of the punch.

Smoothy's lawyer, Nicole Murphy, argued in court that a conviction could jeopardise the skiing career of the two-time winner of New Zealand's Big Mountain Freeski Open.

A submission to discharge without conviction was turned down by Judge Dominic Flatley, who said Smoothy's behaviour would not be tolerated.

The free-skier, previously dealt with by the police diversion scheme, was not eligible to apply again for his recent assault. Smoothy could not be contacted yesterday by the Otago Daily Times.
