Firms withdraw Quail Rise appeal

Four companies, including Steve Rout Contracting Ltd (in receivership) have withdrawn an appeal to the Environment Court regarding a private plan change at Quail Rise.

In his final orders, Judge Jon Jackson recorded the withdrawal of the appeal from SRC, Jaron McMillan, Reavers (NZ) Ltd and Procure Concrete Ltd, the latter also owned by Steve Rout; with no order for costs.

The matter related to Quail Rise Estate Ltd's 2009 plans to rezone about 19.9ha of land south of the existing Quail Rise zone, Queenstown, to low density residential, providing for about 117 additional residential allotments.

A small portion of land was also proposed to be zoned as a corner shopping centre to provide for local amenities.

The proposal was amended to rezone about 11.8ha, providing for an additional 51 residential units and, with the exception of about 3.5ha of land zoned rural general, it was proposed to restrict access to land within the existing Quail Rise open space and Quail Rise rural residential zones.

The matter was heard before independent commissioners Leigh Overton and Cath Gilmour in September 2010, with a decision issued on December 22.

The appeal period closed on February 21 this year. Two appeals were received. One of those was from Gallaway Cook Allan Lawyers on behalf of the four companies, the other from Quail Rise Estate Ltd.
