Man claims friend drugged, raped him

A man has told Palmerston North District Court he was drugged and raped by a 46-year-old male friend.

The accused, a Horowhenua man with interim name suppression, allegedly used an air-freshening substance to drug the 29-year-old complainant, and is charged with stupefying and two counts of unlawful sexual connection on July 18, 2006.

Crown prosecutor Sherie Clarke, at the start of the trial yesterday, said the accused man had asked his friend over to his house for dinner and drinks while his female partner was away on business, the Manawatu Standard reported.

They had been close friends for about a year and shared a common interest in music.

After a few wines and dinner they were "messing about" with musical equipment when the accused held a bottle under the complainant's nose and he was told to sniff.

"He immediately felt like he had been hit in the head with something," Miss Clarke said

It was discovered the bottle, which the victim found later was labelled "Jungle Juice", contained amyl nitrite, a drug commonly used in association with homosexual activity, she said.

The complainant told the court he blacked out and woke up on a bed to the accused pulling his pants off.

While he was drifting in and out of consciousness the accused performed a sex act on him.

The complainant said the accused then had sex with him.

When he woke in the morning, he had a pounding headache, he was not wearing his boxers and there was a bottle of lubricant at the foot of the bed.

"I was in shock. I knew it had been used, but I didn't understand the full picture at that point."

Flashes of memory started to return and he noticed the room was "in a state of chaos", but his shoes were neatly placed by the bed, he said.

The trial continues before Judge Alastair Garland.
