Jet-boat company may face appeal

Kawarau Jet and sister company Clearwater Pursuits say they are considering an Environment Court appeal against consent approvals for Thunder Jet to operate sightseeing trips on Lake Wakatipu and the Kawarau River.

Kawarau Jet Ltd director Andy Brinsley was asked to comment yesterday on the approvals with conditions by commissioners John Matthews and Leigh Overton, in a 121-page decision released after a hearing in July.

Kawarau Jet maintained a second jet-boat operation was a safety risk to water users, but the commissioners accepted the evidence of 11 witnesses who submitted it was not an issue as long as Maritime safety rules were adhered to.

Mr Brinsley said yesterday the commissioners' decision "ignores and clearly disregards" key facts and evidence, including evidence the High Court accepted earlier this year.

"The decision also fails to apply fundamental principles of the Resource Management Act and district plan, which require adverse effects, particularly relating to safety on the district's waterways, to be avoided or mitigated."

Mr Brinsley said any suggestion to share another private radio channel in place of, or in addition to, Kawarau Jet's existing channel was not only inherently unsafe, but also defied practical common sense.

Frankton resident Joanne Boyd opposed the applications because of concerns over safety, environment, noise and the lifestyle and wellbeing of adjacent residents.

Mrs Boyd declined to comment on the decision or if she would appeal yesterday, as she had yet to read the report.
