Company gains stay

An application for a stay of abatement made by the owner of the Bunker Restaurant and Bar to the Environment Court has been granted by Judge Jon Jackson.

In his decision, dated October 10, Judge Jackson said Grey Door Ltd, the owner of the Bunker, had applied for the stay of abatement in respect of its premises at 14 Ballarat St, subject to two conditions, including one that outdoor areas may only be used by smokers between 10pm and 8am.

The company had been issued an abatement notice by the Queenstown Lakes District Council on September 8. Grey Door Ltd lodged its application for a stay the following day.

The abatement notice was issued by the council "because of issues in regards to compliance" with its resource consent.

"The compliance issues are largely to do with noise and sound emanating from the premises.

"QLDC and Grey Door Ltd have had discussions in relation to the stay and Grey Door Ltd has advised the court that QLDC is prepared to consent to the stay, subject to conditions.

"The conditions have been agreed to by both parties.

"Since there is no objection from QLDC and Grey Door Ltd is actively pursuing a variation to consent, I am prepared to grant the stay, subject to the agreed conditions," Judge Jackson said.
