Dwellings approved, subject to 34 conditions

Agreement has been reached between the parties involved in a dispute over the construction of two dwellings and associated buildings at St Bathans.

The matter was before the Environment Court and Judge Jon Jackson said the parties had reached agreement and the initial Central Otago District Council decision granting resource consent was confirmed, subject to 34 conditions.

In a written report on the matter issued late last week, Judge Jackson said 26 parties - individuals and groups - were involved.

David Ford and Kimmer Griffith, of Naseby, were granted consent in March 2008 to build in a rural resource area subject to outstanding landscape value, at St Bathans.

The site was close to the St Bathans Historic Precinct and the application was opposed by individuals and groups, including both the New Zealand Historic Places Trust and St Bathans Heritage and Environment Preservation Trust.

Conditions of consent cover the size and height of the dwellings, building materials, the location of the driveways and landscape plantings.

The existing hawthorn hedges must be retained and plantings must "reflect the type and form of existing planting at the township," the report said.

One of the sites contains the old school ruins.

The original single west room of the school was built in 1875 and an east side was added in 1895.

The building was abandoned in 1948, after suffering earthquake damage. Some of the conditions of resource consent restrict how close fences, driveways and earthworks are to the old school ruins.
