Rapist jailed after delays

Wairarapa rapist Jareth James Fittall, 23, was sentenced in Wellington District Court this morning to two years and eight months in jail.

The Pahiatua invalid beneficiary was found guilty by a jury in a unanimous verdict in November.

Sentencing has been delayed twice this year while Judge Denys Barry awaited reports on Fittall's serious eye problems and his mental state.

Despite the need for surgery in one eye and treatment for the effects of a corneal graft rejection by the other, there was no suggestion Fittall's problems "cannot be catered for in the prison environment," Judge Barry said.

He noted that the offending "was not born out of any mental illness or warped cognition," although Fittall clearly had "personality and psychological frailty" and was currently on anti-depressants and anti-psychotic medication.

Judge Barry said there was a long history of involvement with Child Youth and Family and mental health services.

As a youngster, Fittall's diagnosis had included attention deficit disorder and borderline personality but he did not have a mental disorder.

He had no previous convictions.

Fittall was charged with sexual violation by rape at Masterton on October 18, 2009, after luring a 16-year-old virgin with promises of love and marriage.
