Weatherston (33), has denied murdering his former girlfriend Sophie Elliott (22) who was stabbed to death in her Ravensbourne home on January 9 last year.
The trial was to have begun at 10 o'clock today in front of Justice Judith Potter of Auckland.
But because of ongoing legal argument, Crown and defence counsel agreed potential jurors should be sent away until tomorrow morning.
The argument is in closed court and cannot be reported but media representatives are allowed to be present.
