Policeman to appeal conviction for assault with intent to injure

The second of two Dunedin police officers convicted of assaulting and injuring a man they were trying to restrain is appealing his conviction.

Constable Duncan Hollebon filed an appeal with the Dunedin District Court on August 18.

Const Hollebon and a colleague, Constable Brenton Rooney, were sentenced by Judge Paul Kellar in July in relation to convictions arising from an incident in February last year.

In that incident, Mosgiel man Murray Weil was assaulted and injured while being restrained by the two on-duty officers.

Const Hollebon's lawyer, Anne Stevens, said her client was appealing his conviction on the assault with intent to injure charge.

Const Rooney, who was convicted of the more serious charge of injuring with intent to injure, has already given notice that he intends to appeal his conviction.

The hearings for both officers' appeals have been set down for February 9 next year.

Both men's actions with regard to Mr Weil's treatment are being investigated by New Zealand Police as part of its internal disciplinary process, which commenced after the men were sentenced.

Southern police district operations manager Inspector Lane Todd said the police internal inquiry was now a separate process to the criminal process and would continue to its conclusion irrespective of the appeals, or their outcomes.

The police inquiry is expected to conclude this month.

Both men have been suspended on full pay since February 16 last year, the day after the incident.
