Progressive Enterprises' appeal against a Dunedin City Council decision to deny consent for a new Countdown store will head to what could be a two-week hearing in the Environment Court next month.
The supermarket operator had hoped to build a store on a 1.1ha site on a former car yard bordering Andersons Bay Rd, but the plan was rejected by a council consent hearings committee in April.
Committee chairman Cr Richard Walls said at the time the positioning of the proposed supermarket did not give appropriate recognition to the heritageof the gasworks museum next door.
The hearing will beginon November 15, with two weeks set aside for thecase.
