The Central Otago District Council has yet to be notified of an Environment Court appeal lodged by the developer behind a controversial Cromwell subdivision.
River Terrace Development Ltd has until Monday to appeal a decision relating to Plan Change 13, which would have led to the rezoning of land near State Highway 6 to allow for about 900 lots to be subdivided.
The private plan change was declined after an independent commissioners’ hearing last year.
Central Otago District Council planning manager David Campbell confirmed no appeal had been lodged.
"We have not heard or seen anything from [River Terrace Developments] or the Environment Court objecting to the findings of the independent commissioners."
The plan change would rezone 49.8ha of land on the corner of the highway and Sandflat Rd, opposite the Highlands Motorsport Park and near the Central Motor Speedway. River Terrace Developments would then build 840 houses there, as well as a retirement village, cafes, restaurants, shops, a medical centre and possibly a school.
River Terrace Developments is part of Chris and Michaela Meehan’s Winton Group.
Mr Campbell said it was not unheard of to be notified of an appeal at the eleventh hour and there was still the possibility that would happen.
The council was still owed $259,651.45 by the developer in fees related to its application, he said.
A decision on whether the developer has to pay also rests with an independent commissioner; a resource consent application by River Terrace Developments is to be heard at a hearing on Wednesday.
Mr Campbell said the developer had a right to object to costs.
