Liquidation sought

An application for putting Burns Group 2018 Ltd into liquidation will be heard by the High Court at Dunedin on March 2.

The sole director is listed as Dunedin businessman Malcolm John Burns while the shares in the company are held by Mr Burns and Leonard Cheng.

The plaintiffs are listed as Jeffrey Philip Roberts, Rosslyn Valerie Roberts and Cook Allan Gibson Trustee Company Ltd.

Burns Group 2018 Ltd was incorporated in March 2018 and on the New Zealand Companies Office website, is described as a holding company operation-passive investment in subsidiary companies.

It owns Mosgiel-based Otago Excavation, which is in receivership and liquidation. The receivers’ first report last month showed creditors were owed more than $3.3 million.

It also owns Forest Distribution and Logistics, and Titan Bulk Haulage. In 2021, Titan Bulk Haulage assets were repossessed by Kiwibank subsidiary Kiwi Asset Finance. A report by Kiwi Asset Finance said Titan Bulk Haulage owned the finance company $1.47 million.

Lloyd Heslop Motors, of Nelson, and Wellington truck parts company Multispares NZ Ltd have both previously tried to liquidate Titan Bulk Haulage. Both matters were settled out of court.
